The Commission for Conciliation, Mediation & Arbitration furnished the parties with a set down notice to meet on 15 September 2016 under the auspices of the CCMA.
The conciliation was chaired by the commissioner Yusuf Nagdee.
It became quite evident after the parties have tabled their positions that a certificate of non- resolution will not be issued. The 19 items on the collective agreement made it very technical to summarily issue a certificate of non-resolution.
This was after Management responded by reporting that they have endeavoured to engage labour on the outstanding issues of the Settlement Agreement. Labour were blamed for not accommodating Management during a Prasa Bargaining Forum meeting, which took place in the week of 22 to 23 August as these matters were part of the agenda to be discussed and Labour saying but the issues are in dispute and will be dealt with at the CCMA.
A long deliberation followed on the issuing of a certificate to give labour the right to go on a protected strike. It became quite evident that in terms the labour relations act 66 of 1995 (schedule 4) chapter 111 (section 24) that in terms of a collective agreement that after conciliation has failed to resolve the dispute through Arbitration.
By the guidance of the Commissioner it was decided that Management will be given time until 23 September 2016 to respond with documentary evidence to substantiate their compliance with the outstanding issues on the settlement agreement. In this instance Management must by 23 September 2016 submit their response on all the outstanding matters.
Labour will then scrutinise the response in preparation to meet again at the CCMA.
